Moore was the idol of the Bloomsbury group, and Lytton Strachey declared that Principia Ethica marked the rebirth of the Age of Reason. This chapter sets out the traditional natural law defense of the claim that the death penalty can in principle be a just punishment for certain offenses. It begins by explaining the relevant principles of traditional natural law theory and how they are grounded in a broadly Aristotelian-Thomistic metaphysics. It then shows how the goodness of retribution follows from these principles, and thus is intelligible given that metaphysical picture. This is followed by an application of these results to the justification of (...) capital punishment specifically, as an instance of retributive justice. Finally, Feser responds to some objections. According to the offense principle, the fact that wrongs are offensive makes them eligible for criminalization. Section “Introduction” unpacks this principle. Section “Offense and Offensiveness” discusses what it is for X to be offensive. Section “Offensiveness and Criminalization” argues that, whether we interpret offensiveness subjectively or objectively, the offense principle is not a sound principle. The fact that a wrong is objectively offensive does not bear on whether it should be criminalized. The fact that a wrong is subjectively offensive is (...) no reason to tackle it using the criminal law. Section “The Value of Offense” considers the conditions under which offense has value. It argues that, under some conditions, the fact that X is subjectively offensive counts against criminalizing X, while the fact that X is not subjectively offensive counts in favor of criminalization. Feinberg’s version of the offense principle—which holds that subjective offensiveness gives us reason to criminalize—is something close to the opposite of the truth. (shrink)

Clinical research under the usual regulatory constraints may be difficult or even impossible in a public health emergency. Regulators must seek to strike a good balance in granting as wide therapeutic access to new drugs as possible at the same time as gathering sound evidence of safety and effectiveness. To inform current policy, I reexamine the philosophical rationale for restricting new medicines to clinical trials, at any stage and for any population of patients (which resides in the precautionary principle), to (...) show that its objective to protect public health, now or in the future, could soon be defeated in a pandemic. Providing wider therapeutic access and coordinating observations and natural experiments, including service delivery by cluster (wedged cluster trials), may provide such a balance. Nik Byle argues that Dietrich Bonhoeffer theologically adapts Heideggerian concepts about human existence such as temporality. Bonhoeffer is thus able to provide a positive account of Christ’s relation to time and history moving, Bonhoeffer beyond impasses found in both dialectical and liberal theology.

Heidegger scholarship has done an admirable job accounting for Luther’s influence on key Heideggerian concepts such as his method of destruction and anxiety. Yet given Heidegger’s statements concerning Luther’s immense personal and philosophical importance, it is likely that Luther’s influence extends further and deeper than might first appear. I argue that this influence also manifests in Heidegger’s concept of authentic existence. In particular, I argue that Luther’s understanding of Christian freedom and servitude form ontic material from which Heidegger draws to (...) come to his general ontological understanding of Dasein’s freedom as power over its existence and servitude to its communal involvements. As Luther understands the freedom of a Christian, everything comes to aid the Christian in salvation, much like Dasein gains power over its existential possibilities in coming to authenticity. Yet this newly created freedom also creates additional ontological or existential connections with one’s community. The consequence of such connections is the addition of new responsibilities, or form of servitude, to one’s community wherein one aids others in coming to faith or authenticity, respectively. What sense could it make to describe your life as ‘unlivable’? What is it not only to be alive but to have a life that you live or lead? I answer by developing a social understanding of the pursuit of meaning in life. True to other uses of ‘meaning,’ I propose, meaning in a life is communicative. If you experience your life as ‘unlivable,’ recovery can lie in this communicative dynamic: you regain the experience of leading your life by letting (...) others remind you of meanings you have communicated to them in leading it. My argument develops an analogy between two dimensions in which you project an investment – a care, concern, love, or the like – when you form an intention or plan. Intrapersonally, you project your investment as communicatively intelligible to your own future self at ‘plan’s end.’ Interpersonally, you project it as communicatively intelligible to others who might come to love this thing that you love simply because you love it, as an expression of love for you. The normativity of meaning in your life puts rational pressure on you not only to abandon investments that you cannot communicate but to experience the meaning in investments that you retain. This book presents a systematic account of the role of the personal spiritual ideal of wu-wei--literally "no doing," but better rendered as "effortless action"--in early Chinese thought. Edward Slingerland's analysis shows that wu-wei represents the most general of a set of conceptual metaphors having to do with a state of effortless ease and unself-consciousness. This concept of effortlessness, he contends, serves as a common ideal for both Daoist and Confucian thinkers. He also argues that this concept contains within itself (...) a conceptual tension that motivates the development of early Chinese thought: the so-called "paradox of wu-wei," or the question of how one can consciously "try not to try." Methodologically, this book represents a preliminary attempt to apply the contemporary theory of conceptual metaphor to the study of early Chinese thought. Although the focus is upon early China, both the subject matter and methodology have wider implications. The subject of wu-wei is relevant to anyone interested in later East Asian religious thought or in the so-called "virtue-ethics" tradition in the West. Moreover, the technique of conceptual metaphor analysis--along with the principle of "embodied realism" upon which it is based--provides an exciting new theoretical framework and methodological tool for the study of comparative thought, comparative religion, intellectual history, and even the humanities in general. Part of the purpose of this work is thus to help introduce scholars in the humanities and social sciences to this methodology, and provide an example of how it may be applied to a particular sub-field. The so-called ergodic hierarchy (EH) is a central part of ergodic theory. It is a hierarchy of properties that dynamical systems can possess. Its five levels are egrodicity, weak mixing, strong mixing, Kolomogorov, and Bernoulli. Although EH is a mathematical theory, its concepts have been widely used in the foundations of statistical physics, accounts of randomness, and discussions about the nature of chaos. We introduce EH and discuss its applications in these fields.

Moral naturalists are often said to have trouble making sense of inter-communal moral disagreements. The culprit is typically thought to be the naturalist’s metasemantics and its implications for sameness of meaning across communities. The most familiar incarnation of this metasemantic challenge is the Moral Twin Earth argument. We address the challenge from the perspective of analytic naturalism, and argue that making sense of inter-communal moral disagreement creates no special issues for this view.

ABSTRACT:Officials must understand why and how the public lost confidence in the federal government’s ability to manage financial turmoil. Officials outsourced to private parties responsibility for monitoring and policing the safety-net exposures that were bound to be generated by weaknesses in the securitization process. When the adverse consequences of this imprudent arrangement first emerged, officials claimed for months that the difficulties that short-funded, highly leveraged firms were facing in rolling over debt reflected only a shortage of aggregate liquidity and not (...) individual-firm shortages of economic capital. Then, in September 2008, the president and other officials created an unwise sense of urgency that delays in implementation show to have been greatly exaggerated.That authorities and financiers violated common-law duties of loyalty, competence, and care they owe to taxpayers indicates a massive incentive breakdown in industry and government. Taxpayers deserve a thorough-going reorientation of: (1) how regulatory agencies report on their regulatory performance and back-room interactions with Congress and the Treasury, and (2) the contract structures and performance measures used by the financial industry and its government overseers. This paper investigates the question of, and the degree to which, Newton’s theory of space constitutes a third-way between the traditional substantivalist and relationist ontologies, i.e., that Newton judged that space is neither a type of substance/entity nor purely a relation among such substances. A non-substantivalist reading of Newton has been famously defended by Howard Stein, among others; but, as will be demonstrated, these claims are problematic on various grounds, especially as regards Newton’s alleged rejection of the traditional substance/accident dichotomy (...) concerning space. Nevertheless, our analysis of the metaphysical foundations of Newton’s spatial theory will strive to uncover its unique and innovative characteristics, most notably, the distinctive role that Newton’s “immaterialist” spatial ontology plays in his dynamics.
